Welcome to ABIRTEK.com (“ABIRTEK,” “we,” “our,” or “us”). These Terms of Service (“ToS”) govern your access to and use of the ABIRTEK platform, including challenges, solutions, projects, startups, and related services (collectively, the “Platform”). By using the Platform, you agree to these ToS and our Privacy Policy. If you do not agree, you must not use the Platform.

1. Eligibility
   You must be at least 18 years old (or the age of legal consent in your jurisdiction) to use the Platform. By registering, you represent that you meet this requirement and have legal authority to enter into this agreement.
2. Accounts & Registration
   To post challenges, submit solutions, or participate in projects or startups, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and all activity on your account. Notify us immediately at cs@abirtek.com if you suspect unauthorized use.
3. Platform Use
   Challenge Posters: You agree that all challenges you post are accurate, lawful, and do not infringe the rights of third parties.
   Collaborators/Solvers: You agree that any solution, content, or submission is original and does not violate intellectual property or proprietary rights.
   No Guarantees: ABIRTEK does not guarantee results, funding, partnerships, or the success of any project.
4. User Content & Intellectual Property
   Ownership: You retain ownership of content you submit.
   License to ABIRTEK: By submitting content, you grant ABIRTEK a non-exclusive, worldwide, royalty-free, sublicensable, and irrevocable license to use, host, display, and share your content in connection with the Platform.
   Responsibility: You are solely responsible for the legality and accuracy of your submissions. ABIRTEK disclaims liability for user-submitted content.
   Infringement Notices: If you believe your IP rights are infringed, contact us at cs@abirtek.com with details (DMCA/PDPA compliance applies).
5. Code of Conduct
   You agree not to:
   • Violate laws or infringe others’ rights.
   • Post offensive, abusive, misleading, or harmful content.
   • Impersonate others or misrepresent identity.
   • Interfere with Platform security or functionality.
   We may suspend or terminate accounts that violate these rules at our discretion.
6. Payments & Fees (if applicable)
   Fees for posting challenges, solutions, or services (if introduced) will be disclosed before purchase.
   Payments are processed by third-party providers; ABIRTEK is not liable for their errors or acts.
   Unless otherwise stated, fees are non-refundable.
   Users are responsible for any taxes that may apply.
7. Disclaimers & Limitation of Liability
   The Platform is provided “as is” and “as available” without warranties of any kind.
   ABIRTEK is not liable for direct, indirect, incidental, or consequential damages from use of the Platform.
   Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted.
8. Termination
   You may terminate your account at any time by contacting us.
   We may suspend or terminate your account or restrict access at our discretion, including for breach of these ToS.
   Survival: Sections on Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and Dispute Resolution survive termination.
9. Modifications
   We may revise these ToS at any time. Updated terms will be posted on the Platform with a new effective date. Continued use after updates constitutes acceptance.

    To users: via email or Platform postings. Notices are effective upon sending or posting.
11. Governing Law & Dispute Resolution
    These ToS are governed by the laws of Thailand (without regard to conflict of laws).
    Any dispute will first be attempted to be resolved amicably. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
